Fanvideos of shows and movies on Youtube considered a public performance?

You know how on dvd of shows and movies there’s a warning sign by FBI saying no copying, public performance etc….

Well if you made a fanvideo on your favorite movie or show using clips directly from there and uploading your vid on youtube, is that considered public performance?

    The author have never claim its copyright protections but if you made fanvideo on youtube is legal only the author have never claim its copyright protections but if you just for enjoy not for enjoy not for.
